CALL TO ORDER
Chairman Booth called the meeting to order at 7:05 p.m.
He said that since there were a number of new commissioners, it would be helpful for each Commissioner to state their name and some general information about themselves.
Commissioner Cassermere arrived at 7:10 p.m.
Following the introductions, Chairman Booth gave a brief overview of the function of the Fair Rent Commission. He stated that the Commission treats the landlord and the tenants as fairly as possible. The State Laws favor the tenants and the Fair Rent Commission can only receive complaints from the tenants. Landlords, however, can come in to the office and the staff will try to give them the best advice possible. The Commission has run programs for landlords and tenants in the past. When hearings are held, the principle participants are sworn in. Following a hearing, the Commission must come up with a decision that is fair to both parties.

Chairman Booth asked Mr. Patterson to give the Commissioners a quick overview of his role as an investigator for the Fair Rent Commission. Mr. Patterson explained that when a complaint is received, he goes to the site and inspects the venue.
2. Chairman’s Report
Chairman Booth stated that he was not going to give a formal report, but would make some comments for the Commission to consider. He explained that the Commission is divided into two groups, the Commissioners and the alternates. He feels that in the future, the word “alternate” should be dropped, since both the Commissioners and those designated as “alternates” both do Commission work. He acknowledged that the ordinances indicate a given number of appointments are alternates, but felt that it should not be used unless it is required by the ordinances.
He then spoke about the new Fair Rent Commission notebook that Ms. Youngerman distributed to the Commission members. Chairman Booth then asked the Commissioners who attended the training session for their comments. Commissioner Church stated that it was helpful to have, particularly in regards to knowing the standards. Commissioner Bernard felt it would be helpful for the new commissioners to go on an inspection with Mr. Patterson. Commissioner Borges-Lopez also found page 3909, which lists the standards to be informative and instructive. Commissioner Cassermere pointed out that the paragraphs are short and to the point. Chairman Booth explained that the Commission had rewritten the ordinances in order to update them and make them more concise about four years ago.
Ms. Youngerman distributed copies of a decision that was made to show the Commissioners how the standards are utilized in the Commission’s decision. She reviewed the material in the Fair Rent notebook for the new members and pointed out that every decision by the Commission can be appealed to Superior Court. The cases that are highlighted in the binders are ones where the Fair Rent Commission’s decision was appealed in Court. These are particularly helpful in understanding how the courts treat the decisions given by the Fair Rent Commission. Information about rental properties is compiled from newspapers and other sources in the staff’s office and available to the public and the Commission. The complaint form has just been reworked and updated. It was suggested that the complaint form include the plaintiff’s email address. Ms. Youngerman explained that the email addresses are recorded on the intake form.
3. Director’s Report
Ms. Youngerman reported that she had attended a meeting with several real estate developers at the Chamber of Commerce. She also reported that the current waiting list for Section 8 housing is 1,000 households and is closed. No new applications are being accepted. The current waiting list for public housing in Norwalk is 1,000 households and is closed. No new applications are being accepted. Twenty percent of the population of Norwalk is spending 50% or more of the household income for housing. When HUD evaluates their criteria for Section 8, they use a standard 28% to 30% of household income for housing. Finally, over the last five years, there has been a 15% decline in Norwalk’s population for ages 18-35. Commissioner Bernard commented that New Canaan also has the same problem because the young people cannot find affordable housing and therefore are forced to move out of town.
Chairman Booth commented that when investigations are done, often the conditions are substandard and the building has to be vacated. The tenants have to be moved out and since there is no housing available, they are moved to a hotel.
Ms. Youngerman then reviewed her written report for the Commission, and highlighted the fact that the number of intakes this month was lower than the month of August. However, a number of the intakes have moved into the complaint category. At the current rate the Fair Rent office is receiving these intakes, there is a 20% increase in complaints at this time over other years. This has been the busiest year for complaints in the last five years.
Fair Rent deals with intake cases and complaints. Everyone who contacts the Fair Rent office is considered an intake case. When the situation requires the attention of the Fair Rent Commission, it becomes a formal complaint when a complaint isd filed by a tenant. Not all cases progress into complaints.
She also reported that the two hearings that were scheduled for the meeting have been postponed until December. Esposito v. Equity Residential will be grouped with three other cases that will be presented in December. D’Alessandro v. Ursone is similar to the case heard in October. Included in Ms. Youngerman’s report was a brief run down on the Esposito v. Equity Residential along with the other three complaints from the same residence. This case will be particularly challenging in that there are some issues involved that could have far-reaching consequences. After reviewing the memo, Commissioner Murray suggested that this issue be sent to Corporation Counsel for an opinion. The Commission was in agreement.
Chairman Booth asked Mr. Patterson if he would like to add anything. Mr. Patterson stated that although Fair Rent had a bit of a breather this month, he felt that with the rising heating cost of gas and electricity, there were likely to be more complaints as the landlords pass the increases onto the tenants. He also felt there may be some cases of landlords breaking leases, rather than adding addendums to the leases. Most of his time is focused on conducting investigations. He informed the Commission that his email was lpatterson@norwalkct.org.
Ms. Youngerman commented that at Arch Street, which was a place where in the past the tenants had a $50 annual rent increase at the most, the landlord contacted the staff about one of the tenants, who is a client with the Department of Mental Retardation. During the process of working with the landlord over the past three months, this landlord is now calling the office for assistance in handling this issue. This tenant was not involved in the group negotiations at Arch Street.

5. New Business
Chairman Booth explained to the Commission that the Police Department had agreed to issue identification cards for the Commission members. Ms. Youngerman would be taking the photographs digitally following the meeting and then they will be taken to the Police Department. Currently, the card states the person’s name, the fact they are a member of the Fair Rent Commission and is signed by the person. Chairman Booth also asked Ms. Youngerman and Mr. Patterson to have a photo identification done.
Chairman Booth also asked whether the Commissioners were interested in having a tour of the Police Station on a Saturday morning. This was agreeable to most of the Commissioners.
It was noted that some educational programs had been done regarding the issues when the police are called after hours for illegal entry by the landlord, lockouts or heat compliance. Ms. Geake asked about the issue of heat complaints that Mr. Patterson had mentioned earlier. Mr. Bernard stated that the best thing a tenant could do was to call the police after hours because the officers will bring in a thermometer and take the temperature. At that point, there is a record of it and the police will then contact the Health Department. That way, the tenant is now backed up by the police report. Mr. Patterson said that the Health Department won’t cite a landlord unless the interior temperature is below 65 degrees. There is one individual in the Health Department whose sole job is relocations. The Relocation Specialist will put the tenants up in a hotel and the City will then cite the landlord for the reimbursement. This is the same if there is a fire in a major building. The City relocates the tenants and the City will only bear the cost for about a week.
Chairman Booth explained that the Fair Rent Commission works closely with the Health Department in regards to inspections and repairs. Ms. Youngerman pointed out that there are two different focuses though. Fair Rent is concerned with the value of the rental space while the Health Department is concerned with the safety of the rental property. These two areas overlap, but there are two distinct issues.
Chairman Booth brought up the issue of electing a Chairman and Vice Chairman for the Commission. He explained that because there were so many new members on the Commission, it might be in the Commission’s best interest to postpone the elections until March 2006 to allow the new members to understand the issues and gain experience. Following some discussion of this, it was generally agreed that postponing the election until March would be wise.

Commissioner Church wondered if this would set the new calendar year to start in March, Mr. Murray said that the term would end in November, as stated in the ordinances and bylaws.

Chairman Booth stated that he had some concerns regarding the set up of the budget. Currently, the budget for Human Relations is $176,000 and Fair Rent budget was listed as $48,000. There are three people on staff. Chairman Booth felt that this was not correct and stated his desire to change it. The staff salaries are listed under the Human Relations portion of the budget, but the Fair Rent staff does the bulk of the work. Chairman Booth stated that he felt it should be one overall budget, the Human Relations and Fair Rent Department with two independent commissions under that heading. Ten years ago, the Fair Rent Commission started to keep statistics. The numbers indicate that the Fair Rent Commission work is in excess of 75% of the overall workload. He stated that he had a meeting scheduled with the Human Relations Chairperson the next day to discuss the issue.
Commissioner Bernard explained that there had been two separate Commission staffs. The Mayor merged the offices. Currently, the Human Relations office has the power to hire a director, while the Fair Rent office does not. During the hiring process, Human Relations did allow the Fair Rent to participate in a limited way. Mayor Collins originally wanted to disband the Commission, but when it was decided to continue the Fair Rent Commission. At this time, the Fair Rent Commission started to keep statistics to justify their existence.
Chairman Booth then stated that the Commission needs to set goals for 2006-07. He explained that it was important to set goals that were attainable rather than just putting down things to make up a list. He then suggested the Commissioners consider the following list:
1. Conduct hearings without undue delay.
2. Timely resolution of complaints.
3. Conduct landlord and tenant seminars.
These have been done in the past, the Commissioners would put on the program
with each one taking an ordinance for discussion. The final presentation is
done
by the Director.
4. Revising and updating the materials.
This was slated for last year, but was not accomplished.
5. Expanding the bi-lingual information material.
6. Seek funding for community outreach programs.
Having more information about what is currently being paid as rent would be
helpful.
Commissioner Geake asked about bilingual seminars. Mr. Patterson explained that in the past he has conducted seminars with the landlords in Spanish. Commissioner Bernard also explained that there have been bi-lingual secretaries and other staff members in the past to help with translation. Commissioner Bernard was curious as to whether or not involving Channel 12 with the possible seminars and having them broadcast. There was some discussion of this idea. Commissioner Church suggested that perhaps one year the Commission could focus on having seminars for tenants and the next year have seminars for the landlords.
Ms. Youngerman also added that she was investigating the possibility of having an intern. She will be meeting with someone in the near future about this. An intern will help with outreach and surveys.
Chairman Booth stated that the Commission must show the highlights for 2004-2005. He said that his statement was simply “No director, kept doors open, provided necessary inspections. Secretary not approved for many months.” Mr. Patterson could add any additional information if he desired.
One thing that Mr. Patterson pointed out that the majority of the funding goes to salaries and overtime. Once that is subtracted, the remainder is usually around $9,000 for both Commissions. Because of this, it is a lean operating department. The reason the two Commissions were joined in 1982 was a cost saving measure. There were five staff members and it was reduced to 3.

Ms. Youngerman suggested that the Commission consider creating a subcommittee to work on updating the forms. Chairman Booth asked for a list of the various different forms on a spreadsheet for evaluation.
4. Commissioner’s Potpourri
Ms. Cassermere asked how a landlord would lodge a complaint. Usually the landlord’s
matters are handled through the court, but the Fair Rent staff is willing to
help if possible.
She was also curious to know how to refer those who need the assistance of the
Fair Rent office. Ms. Cassermere related a recent incident about a woman with
a limited education who signed a lease that had a stipulated rent that was different
from the rent amount she had been told verbally. One of the Commissioners suggested
that perhaps asking the landlord to write an amendment or rider to the lease.
However, it is a legally binding contract.
Commissioner Geake asked how one determines what the rent would be on an apartment. Mr. Church passed her an extra copy of a Fair Rent document that shows the rent ranges for Norwalk. It was also suggested that she check www.rent.net and follow the link to Norwalk.
