The meeting was called to order at 6:40 p.m. by the Chairman.

NFCC REFERRALS
REVIEW FURNITURE MOVING BIDS FOR THE NORWALK HIGH SCHOOL IMPROVEMENT PROJECT
** MRS. BRIGGS MOVED TO AUTHORIZE THE MAYOR, RICHARD A. MOCCIA, TO EXECUTE A CONTRACT WITH ESM VAN & STORAGE TO PROVIDE MOVING SERVICES FOR THE NORWALK HIGH SCHOOL PROJECT FOR A TOTAL NOT TO EXCEED $62,735.10 (ACCOUNT NO. 0904-5010-5777-BO310), AND AUTHORIZE THE NFCC TO ISSUE CHANGE ORDERS ON CONTRACT FOR A TOTAL NOT TO EXCEED $7,200.
Mrs. Shamas said this represents the move needed and encompasses Phase II of the work. They will be renovating 80,000-$90,000 s.f. Some of the items may be going into storage. An RFP went out and they received five bids. ESM was the low bidder. Their budget is $75,000 for this phase. This firm has completed other projects on time and on budget.
Mr. Krummel said one of the critical items is the participation of faculty and administration. In the Brien McMahon project, there were complaints about movers. Mr. Shamas said they have developed spread sheets for staff, who will be labeling and tagging their furniture and items. Staff is on notice to take personal belongings home during the summer.
Mr. Poruban asked about checking into damage claims against ESM. Mr. Shamas said he checked three references, who said they would work with this company again. He has not heard about any damage claims.

REVIEW THE GMP DATED 3/27/07 RECEIVED FROM NEWFIELD CONSTRUCTION, INC. (CM) FOR THE PONUS RIDGE MIDDLE SCHOOL IMPROVEMENT PROJECT
** MR. PORUBAN MOVED TO AUTHORIZE THE MAYOR, RICHARD A. MOCCIA, TO EXECUTE AN AMENDMENT TO ESTABLISH THE GUARANTEED MAXIMUM PRICE (GMP) TO NEWFIELD CONSTRUCTION, INC.’S CONTRACT FOR CONSTRUCTION MANAGEMENT (CM) SERVICES FOR THE PONUS RIDGE MIDDLE SCHOOL IMPROVEMENT PROJECT FOR A TOTAL NOT TO EXCEED $5,829,543 (ACCOUNT NO. 0904-5010-5777-BO317), ESTABLISH AN ALLOWANCE FOR OWNER’S CONTINGENCY IN THE AMOUNT OF $795,528 AND AUTHORIZE THE NFCC TO ISSUE CHANGE ORDERS ON CONTRACT FOR A TOTAL NOT TO EXCEED THE OWNER’S CONTINGENCY ALLOWANCE.
Mr. Shamas said this is a code compliance project. It is primarily renovation of all of the science rooms. They met with the Building Advisory Committee, and the state approved the project in late January. A comprehensive bid package was put out by Newfield, who approved all of the low bidders. The GMP is $5,829,543. The total project cost is $7,610,000. The current budget is $8,600,000 for both the city and state, which means they are under by $1,000,000. They want to do the abatement in the science rooms over the Easter break.

REVIEW THE GMP DATED 4/407 RECEIVED FROM NEWFIELD CONSTRUCTION, INC. (CM) FOR THE NATHAN HALE MIDDLE SCHOOL IMPROVEMENT PROJECT
** MR. KRUMMEL MOVED TO AUTHORIZE THE MAYOR, RICHARD A. MOCCIA, TO EXECUTE AN AMENDMENT (THE GMP) TO NEWFIELD CONSTRUCTION, INC.’S CONTRACT FOR CONSTRUCTION MANAGEMENT (CM) SERVICES FOR THE NATHAN HALE MIDDLE SCHOOL IMPROVEMENT PROJECT FOR A TOTAL NOT TO EXCEED $6,791,807 (ACCOUNT NO. 0904-5010-5777-BO316, ESTABLISH AN ALLOWANCE FOR OWNER’S CONTINGENCY IN THE AMOUNT OF $844,593 AND AUTHORIZE THE NFCC TO ISSUE CHANGE ORDERS ON CONTRACT FOR A TOTAL NOT TO EXCEED THE OWNER’S CONTINGENCY ALLOWANCE.
Mr. Shamas noted that this had been approved last night by the NFCC. He said that this project is similar in scope to Ponus. They received approval from the state in late January and went out to bid in mid February and received 39 bids. Newfield said that Jemco Environmental from West Haven, the low bidder on the demolition, did not bid the project as written and therefore was rejected. The original project budget was $8,200,000. They are under the current budget of $9,400,000. Again, they want to do the abatement work over the April vacation.
Mr. Krummel asked what experience they have with Oscar’s Abatement. Mr. Shamas said that Newfield is familiar with their work, although Norwalk is not. They are a Connecticut firm.

REVIEW BIDS FOR THE CONSTRUCTION OF THE CONCESSION STAND AT BRIEN MCMAHON HIGH SCHOOL
** MR. SUTTON MOVED TO AUTHORIZE THE MAYOR, RICHARD A. MOCCIA, TO EXECUTE A CONTRACT WITH RAY WEINER LLL DBA ALL PHASE CONSTRUCTION FOR THE CONSTRUCTION OF THE CONCESSION BUILDING AT BRIEN MCMAHON HIGH SCHOOL FOR A TOTAL NOT TO EXCEED $353,000 (ACCOUNT NO. 0905-5010-4860-CO237 AND 0905-5010-5777-C0237) AND AUTHORIZE THE NFCC TO ISSUE CHANGE ORDERS ON CONTRACT FOR A TOTAL NOT TO EXCEED $35,300.
Mr. Lo said they are doing an extension to the back of the building. Fletcher Thompson prepared drawings for Gilbane two years ago in order to go out to bid. Recently, he made revisions to the drawings because the bids came in very high. They worked with athletic groups in town to try to reach out for donated work, which did not work out. They went before the NFCC. He decided to put this project back together and go out to bid. It will now be without a metal roof. Heating system bids came in at approximately $350,000. They received five bids, with the low bidder being All Phase, a company that has done several projects in Norwalk. With the contingency, the cost is almost $400,000. They intend to use the money from the sale of property on Lenox Avenue.
Mr. Krummel said he was leery of spending money like this because there will be no state contribution, and he asked where people have been getting refreshments for the past two years. Mr. Lo said that a stand had been set up.
Mr. Krummel asked if Gilbane was acting as the construction manager. Mr. Lo said they are not; this is his project. The goal is to finish it by September 1st.
Mr. Krummel said this is a luxury, and with the flooding problems in town, he wonders if this is justified. In addition, there had been talk about having the booster club contribute to this. Mr. Lo said he tried to work with them, but it is not that simple. There are liability issues and questions about who would own the building. The Board of Education will manage the concession stand.
Mr. Krummel said he would vote against this item.
Mr. Poruban said he thought that the Recreation & Parks department would have ownership. Mr. Lo said that the Board of Education pays utilities. Mr. Poruban asked why heat would ever be put into this concession stand. Mr. Lo said that is why it was taken out.
Mrs. Briggs asked if there were bathrooms; Mr. Lo said there are two. They will be used for the public during games so that the school does not have to be opened.
Mr. Lo said that the construction will be block, approximately 1,000 s.f. at $350 per s.f. Mrs. Briggs said that the cost was atrocious. Mr. Lo noted that this did not include kitchen equipment. They will probably buy used equipment.
Mr. Poruban asked the cost of the concession at Norwalk High. Mr. Lo said it was probably in the area of $250,000.
** MOTION FAILED WITH TWO VOTES IN FAVOR (MR. PORUBAN, MR. SUTTON), TWO OPPOSED (MRS. BRIGGS, MR. KRUMMEL).
The Chairman said that he would forward this to the Common Council.
