CALL TO ORDER

The meeting was called to order at 8 p.m. by the Chairman.

ROLL CALL

PUBLIC HEARING

#3553 – CAROL ROYCE/TIM ROTH – 47 NEPTUNE AVENUE – 2 LOTS

This public hearing took place.

REPORT OF THE SUBDIVISION COMMITTEE

#3553 – CAROL ROYCE/TIM ROTH – 47 NEPTUNE AVENUE – 2 LOTS

**        MS. DIMEGLIO MOVED:

RESOLVED that subdivision application # 3553, submitted by Carol Royce for 2 lot subdivision at 47 Neptune Avenue, as shown on a plan entitled "Subdivision Map of Property Prepared for Tim Rath, 47 Neptune Avenue, Norwalk, Connecticut, Scale 1" = 10', dated March 14, 2003" and certified "substantially correct" by Wayne Arcamone, L.S., Connecticut Registration No. 15,773 be approved, subject to the following conditions:

1.      That a surety, in an amount to be determined by staff, be submitted to guarantee the installation of the required site improvements; and

2.      That all required soil and sedimentation controls be in place prior to any site work; and

3.      That any additional soil erosion and sedimentation controls deemed necessary by the staff be installed at the direction of the staff; and

4.      That the two existing sheds be removed from the newly created lot, in order to prevent a setback violation.

BE IT FURTHER RESOLVED that the sidewalk and curb requirement be waived as conditions do not/do require their installation; and

BE IT FURTHER RESOLVED that the existing street trees which meet the street tree requirement be maintained or new street trees meeting the requirement be installed; and

BE IT FURTHER RESOLVED that the proposal is consistent  with all applicable Coastal and Resource use policies.

**      MR. BERMUDEZ SECONDED.

**      MOTION PASSED UNANIMOUSLY.

#3512 – PAT J. CUTRONE – OBSERVATORY PLACE – 5 LOTS ON AN EXISTING ROADWAY DEVELOPED TO CITY STANDARDS – REQUEST FOR RELEASE OF SURETY

**        MS. DIMEGLIO MOVED:

RESOLVED by the Norwalk Planning Commission that the surety held on Subd # 3512 - Pat J. Cutrone - Observatory Place - 5 lots, be released as the improvements have been installed as required and have been properly maintained;

BE IT FURTHER RESOLVED that a maintenance surety be submitted as required to guarantee the continued good condition of the installed required improvements.

**        MR. ASTROM SECONDED.

**            MOTION PASSED UNANIMOUSLY.

#3525 – PASCALE LEE AND NICOLA TARZIA – 12 EMERSON STREET – 2 LOTS – REQUEST FOR RELEASE OF SURETY

**        MS. DIMEGLIO MOVED:

RESOLVED by the Norwalk Planning Commission that the surety held on Subd # 3525 - P. Lee & N. Tarzia - 2 lots - 12 Emerson Street  be released as the improvements have been installed as required and have been properly maintained.

BE IT FURTHER RESOLVED that a maintenance surety be submitted as required to guarantee the continued good continued good condition of the required improvements.

#3540 – ONE-HUNDRED-SEVENTY-FOUR NORTH TAYLOR LLC – 174 NORTH TAYLOR AVENUE – 2 LOTS – REQUEST FOR RELEASE OF SURETY

**        MS. DIMEGLIO MOVED:

RESOLVED by the Norwalk Planning Commission that the surety held on Subd # 3540 - One Hundred Seventy Four North Taylor Avenue, LLC, 2 lots, 174 North Taylor Avenue be released as the improvements have been installed as required and have been properly maintained.

BE IT FURTHER RESOLVED that a maintenance surety be submitted as required to guarantee the continued good condition of the required improvements.

**            MOTION PASSED UNANIMOUSLY.

#3549 – J.J. VELEZ – 1 INDIAN PLACE/OBSERVATORY PLACE – 3 LOTS – EXTENSION OF DEADLINE

**        MS. DIMEGLIO MOVED:

RESOLVED that subdivision application # 3549, submitted by J. J. Velez for a 3 lot subdivision at 1 Indiana Place/Observatory Place, be granted an 90 (ninety) day extension of the approval time in which to file the approved map on the Norwalk Land Records; and

BE IT FURTHER RESOLVED that the new deadline to file the map is March 25, 2004.

**        MR. ASTROM SECONDED.

**            MOTION PASSED UNANIMOUSLY.

REPORT OF THE LAND USE COMMITTEE

DEP/AC – CONNECTICUT LIGHT & POWER COMPANY – NEW CANAAN AVENUE AT THE NORWALK RIVER – EXPAND SUBSTATION AND CONSTRUCT A FLOOD CONVEYANCE CHANNEL

**        MR. ASTROM MOVED:

RESOLVED by the Norwalk Planning Commission that, in reviewing the Stream Channel Encroachment application # SCEL-2002-21, submitted by the Connecticut Light and Power Company for the construction of a flood conveyance channel in the Norwalk River, adjacent to the New Canaan Avenue CL&P substation, it is impossible to determine compliance with the design approved by the City due to insufficient data; and

BE IT FURTHER RESOLVED that notice of this action be forwarded to the Common Council. 

**        MS. DIMEGLIO SECONDED.

**            MOTION PASSED UNANIMOUSLY.

DEP/AC – CONNECTICUT DEPARTMENT OF TRANSPORTATION – ROUTE 7/ROUTE 15 INTERCHANGE – RECONSTRUCTION INTERCHANGE AT MAIN AVENUE AND NORWALK RIVER

**        MR. ASTROM MOVED:

RESOLVED by the Norwalk Planning Commission that the following comment be made on the referral from DEP (# IW 2000-105, SCEL-2000-08), regarding DOT Project #102-269, the reconstruction of the Glover Avenue bridge and the reconstruction of the Rte 7 / 15 interchange at Main Avenue:

That it supports the proposal and encourages that the construction be undertaken as quickly as possible.

BE IT FURTHER RESOLVED that notice of this action be forwarded to the Common Council.

**        MS. DIMEGLIO SECONDED.

**        MOTION PASSED UNANIMOUSLY.
