ZONING BOARD OF APPEALS
AUGUST 7, 2008
Approved September 4, 2008
Ms. Carbone called the meeting to order at 7:30 pm.
PRESENT: Anne Carbone; Taylor Strubinger; Gordon Tully; Nathan Sumpter
STAFF: Aline Rochefort, Zoning Inspector; Vladimir Mariano, Deputy Zoning Inspector; Mike Greene, Director
OTHERS: Shawn Mullane; Attorney Robert Rubin
Ms. Carbone announced that Item D. would be postponed until next month.
Attorney Robert Rubin, representing the applicant, agreed to have Items A. and B. postponed until the September meeting, in order for the items to be heard by five Commissioners.
The applicant agreed to proceed with the public hearing with only four Commissioners present. Ms. Carbone opened the public hearing. Mr. Tully read a memo from Ms. Rochefort. Mr. Mullane turned in the green cards. He explained that the proposed change involved less than a foot on the rear setback. He added that the roofline of the property would remain the same.
Mr. Strubinger asked the applicant to walk through the site plans and clarify what was being modified. Mr. Mullane described the location of the stairway in relation to the bedrooms and closet, explaining that the stairway would be moved three feet to the left.
Ms. Carbone asked the staff what could have been done differently to be in compliance and hence not to need a variance. There was a brief discussion of the western elevation on the site plan.
Ms. Carbone closed the public hearing.
This item was postponed until next month.
** MS. CARBONE MADE A MOTION TO APPROVE THE VARIANCE, BECAUSE THE APPLICANT PRESENTED A HARDSHIP DUE TO THE SIZE OF THE LOT AND BECAUSE THE APPLICANT WAS NOT MAKING UNREASONABLE CHANGES TO THE PROPERTY.
** MR. STRUBINGER SECONDED.
** MOTION PASSED UNANIMOUSLY (SUMPTER, TULLY).
The Commission agreed to postpone approval of the minutes until the next meeting.
** MS. CARBONE MOVED TO ADJOURN.
** MR. TULLY SECONDED.
** MOTION PASSED UNANIMOUSLY.
The meeting was adjourned at 8:10 pm.
