SECRETARY
Commissioner Frank reports revised design on Girourd application, which was
used as example of bad design, in presentation to Comm McCarthy has been received.
Change is new float stops fabricated from pipe and forming platform that would
rest on bottom and support dock about a foot off bottom at low tide, After
considerable discussion it was decided that original objection to design should
stand. Site does not have depth to float dock at low tide cycle and would
damage underlying shellfish bed and inhibit harvesting. New float stop design
does not correct problem. Revised drawings do not show surveyed depths. Chair
will inform DEP.

Mr Frank reports comments on Broadwater have been completed and will be presented at oublic hearings and forwarded to FERC and elected officials. Dates for public hearing were announced and everyone at meeting invited to participate in at least one.
CL&P has asked for permit from Aquaculture for resource assessment project on beds they claim near cable right of way. Chair has asked Aquaculture to deny permit, as CL & P may have lost whatever rights they bought in 1968 by failing to exercise them for many years and does not have standing for resource assessment until some permit to replace cables has been issued.
CL & P has recently allowed Roger Fratte to work beds they claim, south of Sheffield Island. Chair suggests this may be a ploy as part of permit negotiations as may be resource assessment application, both intended to get some recognition of their status as shellfish cultivators.
CL & P is currently dealing with leak in same area and has reported various leak rates. Unauthorised sources within the company have told us leak is in 15 litres/hour range and that is probably understated. Brief review of history of cable leaks and CL & P response to them brought some newer commissioners up to date. Harbormaster suggested FOI request might force CL&P and LIPA to produce records of actual oil losses from system.
Tim Pramer has applied for some changes in his permit for upweller floats to be placed on his beds. He anticipates the loss of present location, in Cove Marina and needs to have alternate location readily available. After brief discussion it was agreed that, because all activity under this permit was on or over his own beds, Commission had no jurisdiction, nor concerns. It was suggested to Mr Pramer that he should keep public relations aspect of placing floats in mind and possibly make use of one larger float rather than several smaller ones because of effect on recreational boating. Chair will notify aquaculture, Harbor management, and DEP that application was reviewed.
COMMITTEES
HEALTH DEPT
Mr. Closter reports 2.31 inches of rain in December vs. 4.13 last year and
average since 1987 of 3.16 inches, for annual total of 60.33 inches vs average
of 45.06. There were 250 calls in December and 6639 for the year vs 5518 for
2005. There was an 8-day closure in CAA (.5) and CAA1DN (1.5) areas starting
12/23/06 and there seems to be a change in calculating the length of the closures.
Aquaculture is now more involved and issues re-open orders which seem to make
the closures longer. Mr Closter will try to get clarification.
There were two spill/bypass events in December

WASTEWATERTREATMENT
Mr. Bartoli absent, no report. Mr Johnson reports gates are kept locked at
night at WWT plant, Chair report Mr Alford is trying to get new odor control
system for dewatering building. He seems confident that will help.

WATER QUALITY
Harbormaster Mike Griffin reports no meting in December, no report.
PERMITS
Mr. Casagrande reports new permits are in the stores, since mid Decmeber,
Tide charts are being printed.
POLICE
Sgt LaPak reports 14 Hrs patrol, no arrests. Suspicious vessel was reported
working in Betts Bay very early on 12-24. It left very quickly, has not been
identified. He is working on some equipment upgrades, all security related.
Discussion of security equipment he is looking at was very informative. Commission
may want to participate in some funding.
ADVISORY
Captain Hopp reports water temperature at 44o.
HARBOR MANAGEMENT
Harbormaster Griffin reports DEP has accepted language changes in HMC plan.
Revised plan being reviewed. If, plan is adopted, it will offer greater protection
of shellfish resources. Commission might do well to incorporporate same new
language in management plan.
