Contingency to the registrar of Voters Office to reimburse for penalties and attorney fees for
a complaint made against the Norwalk Registrar’s Office by the State Elections Enforcement

C. NORWALK FACILITIES CONSTRUCTION COMMISSION

1. Authorize the Mayor, Richard A. Moccia, to execute an amendment to
Silver/Petrucelli & Associates architectural/engineering design services
contract for the Kendall Elementary School project, in order to increase the
current hazardous material monitoring allowance by $38,000 for the balance
of the project abatement phases. Acct. # 09045010-5777-B0313 Authorized

2. Authorize the Mayor, Richard A. Moccia, to execute an agreement with W. &
M Construction Corporation as the Construction Manager (CM) for the
Nathaniel Ely Child Care Project. Terms of the agreement shall be per the
RFP and attached memo. Upon receipt of trade contractors’ bids, a
Guaranteed Maximum Price (GMP) will be established which will be based
on the total trade contractors bids, CM General Conditions, CM Fees, CM
Contingency, and reimbursable expenses. The GMP will be submitted to the
Common Council for final approval. Terms of the agreement shall include the
following:
Preconstruction Phase Services (including
Reimbursables allowance) $32,064
CM Fees (% of the cost of the work) 2.75%
Estimated CM General Condition Fees
(to be finalized at the time of GMP) $257,067
CM Contingency (% of the cost of the work) 4%

3a. Authorize the Mayor, Richard A. Moccia, to execute an amendment to the
AT&T Solution’s Equipment and Services Agreement for the Norwalk Police
Station’s portion of the City-Wide Telephone System Platform for a total
additional amount not to exceed $117,233.78. Acct. # 0900/01/03-4031-
5777-C0137 Authorized

3b. Authorize the NFCC to issue Change Orders on contract for a total not to
exceed $11,073.37 Authorized

4. Authorize the Mayor, Richard A. Moccia, to execute an amendment to
Gilbane Building Company’s program management contract for period
beginning January 1, 2006 and ending December 31, 2006 for a total not-to-
exceed $1,036,841. Where applicable, the appropriate fee will be charged
against specific projects for future State reimbursement. Funds are available
from various capital budget accounts. Authorized

US Route 7 at Foxboro Drive, for a sum not to exceed $372,836.73. Subject to
additional funding by Foxboro Court Condominium Association Acct.#0903/04

1b. Authorize the Director of Public Works to issue Orders on Contract to A.M. Rizzo
Electrical Contractors, for Project No. TRF 2005-1, Proposed Traffic Signal US
Route 7 at Foxboro Drive, for a sum not to exceed $20,000.00. Subject to
additional funding by Foxboro Court Condominium Association. Acct. # 0903/04

2. Authorize the Mayor, Richard Moccia, to execute an Amendment to the Agreement with
Fuss & O’Neill, to provide Professional Design and Construction Engineering Services in
Connection with Project No. TRF 2005-1. Proposed Traffic Signal US Route 7 at Foxboro
Drive, for a sum not to exceed $19,000. Acct. # 0904 4210 5777 C0284 Authorized

3a. Authorize the Mayor, Richard A. Moccia, to execute an Agreement with R. Richard Roina,
Esquire, as Trustee, to provide dredging and disposal of sediment accumulated in the boat
launch basins of Total Marine and Norwest Marine, a requirement of the drainage
easements obtained from the two properties in order to implement the combined sewer
overflow prevention program, for a sum not to exceed $39,000. Acct. # 09034027 5777

3b. Authorize the Director of Public Works to make payment to the Army Corps of
Engineers for space for disposal of dredged sediments in the Harbor Dredging
CAD cell under the Project Cooperation Agreement (PCA) for a sum not to
exceed $31,000. Acct. # 09034027 5777 C0138 Authorized

3c. Authorize the Director of Public Works to receive funds from the South Norwalk
Boat Club as a pass through so that the Director may purchase for the South
Norwalk Boat Club from the Army Corps of Engineers space as may be available
for the disposal of dredged sediments in the Harbor Dredging CAD cell under the
project Cooperation Agreement (PCA) after the disposal of the dredge materials
from Total Marine and Norwest Marine and to authorize the Director to pay all
such funds received to the Army Corps of Engineers for such space. Authorized
