Any Norwalk resident who has a question regarding rental matters may contact the office of the Fair Rent Commission for information. The office maintains a library of informational pamphlets on issues of importance to landlords and tenants including: security deposits, utility issues, leases and evictions. ********** Fair Rent Commission The Norwalk Fair Rent Commission is a City Commission that has the power to decide whether a rent increase or the rent charged to a tenant is unfairly high. The Commission has 14 members. It is empowered by state and local law to address the rent paid by an individual tenant who files a complaint regarding the amount of rent or rental increase for the apartment occupied by that tenant. Once a Complaint is filed, the Commission's staff does a site inspection
of the complainant's residence and presents a report to the Commission.
The general condition of the unit, including issues of poor maintenance,
needed repairs, or code violations endangering health and safety are noted.
The Commission works in conjunction with the health, fire, and other city
departments to promote safe housing. If the staff cannot mediate problems
between the landlord and tenant, the Commission holds a public hearing.
In cases where repairs are necessary, repairs may be ordered or rent may
be adjusted and/or escrowed until problems are resolved. The Fair Rent Commission follows these guidelines in determining whether rental charges are excessive: The rent charged for the same number of rooms in other housing accommodations in the same and in other areas of Norwalk. The sanitary conditions existing in the housing accommodations in question. The number of bathtubs or showers, flush water closets, kitchen sinks, and lavatory basins available to the occupants. Services, furniture, furnishings and equipment supplied. The size and number of bedrooms contained. Repairs necessary to make such accommodations reasonably livable for the occupant. The amount of taxes and overhead expenses, including debt service. Whether the accommodations are in compliance with the ordinances of Norwalk and the Connecticut General Statutes The income of the petitioner and the availability of accommodations. The availability of utilities. Damages done to the premises by the tenant, caused by other than ordinary wear and tear. The amount and frequency of increase in rental charges. Whether, and the extent to which, the income from an increase in rental charges has been or will be reinvested in improvements to the accommodations. |
